All sales are subject to availability.  If we are out of stock on an item you order, we will contact you to see if you want to cancel your order or make a substitution. 

Privacy Policy
 
We collect personal information for the sole purpose of completing your order.  Your private information is never sold, shared, or otherwise provided to anyone for any reason.  We value your business and are committed to doing everything possible to make our online ordering process 100% secure.  Credit card information is collected using 128 bit Secure Socket Layer (SSL) technology and deleted once the transaction has been  completed.  Once you have completed your order online, the encrypted information is kept inaccessible and sent directly to the order processing department.  The  department processing orders is not connected to the Internet, so no one can gain access to your information.  

Legal
 
All of our products are intended for adult use only.  You must be at least 18 years of age to make purchases from Midway Knife and Tool.  Not all of the items featured in this website are legal in all states and municipalities.  Check your local laws and ordinances to ensure that the products you purchase are legal in your state and/or local area.  By ordering, the buyer certifies that he/she has checked with all local laws and can legally own the product.  Midway Knife and Tool sells merchandise only to individuals who can legally purchase and own such items in the particular jurisdiction where they reside. 
 
Your purchase of Midway Knife and Tool merchandise, whether in person, by telephone, by mail, by fax, or over the internet, legally binds you and your heirs, assigns, transferees and personal representatives as follows:
When you order and purchase merchandise from MidwayKnifeandTool, you represent that you are of legal age to purchase the merchandise ordered and that the merchandise can be purchased and owned in your state, county and/or city or residence.  By offering merchandise for sale, MidwayKnifeandTool does not represent or warrant that any specific purchaser may legally purchase, own, or posses the merchandise ordered.  CHECK YOUR LOCAL LAWS.

The merchandise Midway Knife and Tool sells may be dangerous, even deadly, if used improperly, negligently, and/or illegaly.  When you purchase merchandise from Midway Knife andT ool, you agree that you will use the purchased merchandise in a safe and legal manner, consistent with all applicable laws, recognized safety rules, and common good sense.
You further agree that you will train and supervise minors in the use of Midway Knife and Tool merchandise and that you will take such steps as may be reasonably necessary or required by applicable law to keep Midway Knife and Tool merchandise out of the hands of minors and untrained and/or immature individuals.
When you purchase merchandise from Midway Knife and Tool, you agree to assume all risks related to and/or arising from ownership and use of the merchandise and agree to indemnify and hold Midway Knife and Tool harmless from any and all claims brought by any person or entity against MidwayKnifeandTool related to and/or from your ownership and/or use of the merchandise.
Midway Knife and Tool does its best to accurately represent the merchandise, through photo, price and copy.  Occasionally we make mistakes.  If such a mistake should occur, your order will be corrected  as the facts may dictate.

Returns
 
If for any reason you are not satisfied with your purchase and it becomes necessary to return merchandise to Midway Knife and Tool, you must contact us for instructions on how to preceed by calling us using our toll free number or sending an Email to us at Customer_Service@midwayknifeandtool.com .  Returns must be received within 30 days of the invoice date, in original factory packaging with all factory paperwork, in unblemished, re-sellable condition, and must include a copy of your invoice or packing slip.  Midway Knife and Tool is not responsible for returns that are not received by us, so please ship your return in a manner in which you may track its receipt and insure it if the value is over $100.00.

Exchanges
 
Due to our business practice of not capturing credit card information, we can only refund up to the full purchase price of the merchandise purchased.  We cannot add additional charges to a customers credit card.  Exchanges are handled as simple returns.  Once the returned merchandise has been received a credit will be issued for the full purchase amount.  The returned marchandise must be in new, re-sellable condition with original factory packaging and paperwork.  Contact our Customer Service Department by using our toll phree number  for any questions regarding an exchange. 

Defective Items, Lost Package, or Damaged Merchandise
 
The products we sell are covered by a manufacturers warranty that specifically requires that the item must be sent directly to the manufacturer for repair or replacement.
 
UPS will settle a lost package or damaged product claim usually within 10 business days.  USPS Priority Mail shipments are not considered lost by the U.S. Postal Service until thirty days from mailing.  Midway Knife and Tool cannot replace a shipment until the investigation period has been completed by either UPS or USPS.  We will contact our local post office to determine if any information can be obtained about the shipment.  If you have not received your shipment after thirty days has passed from the date of shipping, Midway Knife and Tool will file a lost claim and the paperwork will be sent to you to sign and return to us.  Once we have the completed signed claim form we can refund or re-ship your order.
 
If your merchandise is damaged from improper handling you must file a claim with the freight carrier.  If you notice concealed damage after the driver has left, keep all of the packaging and call the freight carrier to return and inspect the damage and file a claim.  We cannot be responsible for damage caused by the freight carrier.

Shipping
 
It is the customers responsibility to provide an address to which an order can be legally delivered, and the customer is responsible for the receipt of the shipment.  All orders are processed in the order in which they are received, and normally ship within 1 to 3 days.  Normal order delivery time is 3 - 7 days, depending on location.  Expedited shipping may be requested when the order is placed, at an additional cost.  All standard shipping costs will be paid by Midway Knife and Tool as our way of saying Thank You for your business.  While the option for a delivery method is provided when a purchase is made, Midway Knife and Tool reserves the right to use Priority Mail or UPS Ground delivery service at our discretion to ensure prompt delivery to our customers.
 

International Orders
 
We welcome international orders, but stress that it is the responsibility of the customer to obtain any applicable import permits/customs clearances, etc., before placing your order.  Packages seized by Customs for your failure to follow local import regulations are not refunded or credited.  You, the customer, are solely responsible for all compliance with your countrys regulations.  Packages that are left unclaimed and forfeited to Customs or the carrier are charged to your account in all cases.  We will not issue credit for these occurrences.  Once an international order has left our warehouse, it is out of our control, and may take up to 3 weeks to receive, though it normally takes only a couple of weeks.  No refunds will be given on international orders.  Order at your own risk, as we can be responsible only for providing proof of shipping, not for the actual receipt of the item(s) by the purchaser.
